These Terms of Service (“Terms”) govern your access to and use of the website located at https://deepcogito.com, the chat experience located at https://chat.deepcogito.com, and our related products and services, including our model experiences and research content (collectively, the “Service”) provided by Deep Cogito Inc. (“Deep Cogito”, “we”, “us”, or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

The Service is intended for a general audience, but our interactive model and chat features are intended only for users who are at least 18 years old or the age of majority where they live. By using those features, you represent and warrant that you meet this requirement. The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

2. The Service

The Service provides information about Deep Cogito and access to artificial intelligence models, research content, and chat experiences developed by Deep Cogito. Features, availability, and performance may change without notice, and the Service may be modified, suspended, or discontinued at any time.

3. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party right;
  • Generate, request, or distribute content that is unlawful, harmful, harassing, defamatory, or that depicts the sexual abuse or exploitation of minors;
  • Generate content intended to facilitate violence, weapons development, or attacks on critical infrastructure;
  • Attempt to reverse engineer, extract the weights of, or derive the training data of our models;
  • Probe, scan, or test the vulnerability of the Service, or circumvent any security or rate-limiting measures;
  • Use the Service to build a competing product or to train another machine learning model;
  • Misrepresent the outputs of the Service as being generated by a human or by another provider.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms.

4. AI-Generated Content; No Reliance

Outputs from the Service's model and chat features are generated by artificial intelligence and may be inaccurate, incomplete, biased, or otherwise unsuitable for your purposes. Outputs do not represent the views of Deep Cogito.

Do not rely on the Service for medical, legal, financial, or other professional advice. You are solely responsible for evaluating the accuracy and appropriateness of any output before relying on or using it.

5. Your Content

You retain ownership of any input you submit through the Service's interactive features (“Input”). You grant Deep Cogito a limited license to process your Input solely to operate the Service and generate outputs for you. We do not use your Inputs to train our models.

6. Intellectual Property

The Service, including the website, models, software, and all associated intellectual property, is owned by Deep Cogito and its licensors. Except for the rights expressly granted to you in these Terms, no rights are granted to you in or to the Service.

7. Feedback

If you provide feedback or suggestions about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF OUTPUTS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEEP COGITO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

10. Indemnification

You agree to indemnify and hold harmless Deep Cogito from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service or your violation of these Terms.

11. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by a revised “Last Updated” date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
